LICENSE-AGREEMENT TO DOWNLOAD-PRODUCTS FROM GEAR FORCE ONE

ADVANCED ACOUSTICS Gear Force One Download Kits and Gear Force One Samples

By downloading or using the download product described below, you agree that you have read and understand the following license agreement and that you agree to fulfill its terms.

Product description, scope of use and limitations

Advanced Acoustics Download Kits (hereinafter: “Download product”) is a collection of downloadable files suitable to be transferred into corresponding electronic drum sound modules.

Gear Force One is the Licensor providing the download product. The license grants the end user (“You”) the non-exclusive right to use the download product in accordance with the terms and conditions set forth in this license agreement.

License terms

This license allows you to make personal, non-commercial use of the download product. Any other use of the download product, including but not limited to commercial use, is prohibited.
The use of the download product for the creation of music productions whose goal is distribution (including commercial distribution) is permitted under the restriction that no sound created by the use of the download product (sound) can be isolated, neither by technical, nor by mechanical or other measures.

Limitations and prohibitions

You are not allowed to reverse-engineer, decompile or technically disassemble the download product or modify it in any way that is not related to the normal operation and handling of the corresponding electronic drum sound module.
The reproduction, distribution to third parties, posting on a data network or other publication, as well as distribution, in particular for the purpose of making a profit, such as through rental, lending, sale or other distribution, are prohibited. This also applies to modified products based on the download product.

You may keep a maximum of three copies as a backup on your computer or other storage device. The copies are for your personal use only.

Limitation of liability

The licensor is not liable for any damage, loss of data or other negative effects that may result from the use of the product. Liability and warranty of the licensor shall only take place in as far as this is expressly regulated by law.

Copyright and intellectual property

All rights related to the download product (including but not limited to copyright/intellectual property, distribution right, reproduction right) are expressly retained by the licensor. No transfer of ownership rights is granted by this license.

Product updates

The licensor may occasionally provide updates or upgrades to the download product; these are subject to the same terms and conditions of this license agreement.

Cancellation of the license

The licensor may terminate the license if you violate the license agreement. In this case, you must immediately stop all use of the download product and delete all copies of the download product.

Data privacy

The licensor collects and uses personal information in accordance with its privacy policy, which you may view on the Internet at the web address https://gearforce.one/datenschutz and to which you hereby consent.

The licensor provides you with a contact form on the internet at the web address https://gearforce.one/kontakt. Alternatively, you can contact the licensor using the communication options provided in the imprint of Gear Force One at the web address https://gearforce.one/impressum.

Applicable law and place of jurisdiction

This License is governed by the laws of the country in which the licensor is located. Any disputes arising in connection with this license shall be subject to the jurisdiction of the courts in that country.
At the time of printing of this license agreement, the place of jurisdiction is Germany.

Your right of use to this manual

These operating instructions are intended for private use, for which a limited right of use exists. This manual may not be copied, or duplicated and reproduced, in whole or in part, and by any method, whether digital, mechanical, or photocopying, transcribing, or otherwise, without prior written permission.

For private backup, the creation of a single machine-readable copy (backup) is permitted; this copyright notice must also be copied.
